AHMEDABAD: Gujarat high court held {that a} Muslim marriage can be dissolved by Mubaraat, a mutual consent divorce, with out the need of a written settlement recording such consent, studies Saeed Khan.Citing Quran and Hadith on the process for dissolution of marriage, the bench of justices A Y Kogje and N S Sanjay Gowda put aside an order by a Rajkot household court that rejected a go well with filed by a Muslim couple in search of dissolution of marriage by Mubaraat.The household court had held the go well with was not maintainable underneath Section 7 of Family Courts Act as a result of there was no written settlement relating to mutual consent for divorce.
