Sanjay Bhandari wins appeal against extradition to India

Defence intermediary Sanjay Bhandari has received his appeal against extradition to India and has been discharged by the London High Court. The 62-year-old Indian nationwide appealed against the choice to extradite him in December saying that he might face violence and extortion in Tihar jail if he was extradited to India. The judgment got here on Friday in his favour on the idea of a breach of Article 3 and 6. He claimed he would face torture, extortion and violence in Tihar jail and an absence of honest trial in India. The excessive court docket judges have agreed with him and he has been discharged.
Tax evasion and cash laundering
Sanjay Bhandari is a UK-based arms vendor who was a resident of India for tax functions in 2015. he used to supply consultancy companies to defence producers bidding for Indian authorities contracts by way of his agency Offset India sSolutions. He was accused of tax evasion and cash laundering in India when he fled to the UK in 2016.
India made two extradition requests for Bhandari, the primary regarding an allegation of cash laundering, opposite to Section 3 of the Prevention of Money Laundering Act 2002 in India. The second was on an allegation of wilfully trying to evade a tax, penalty or curiosity chargeable or imposable below the Black Money Act 2015 opposite to Section 51 of that act in India.
While residing in India, Bhandari didn’t reveal abroad belongings, used backdated paperwork benefitting from the belongings that he didn’t declare to the Indian tax authorities.
He denied the allegations and was preventing his extradition for the reason that first request was licensed by the UK Home Office in June 2020.
