SC calls Khalsa University (repeal) Act 'unconstitutional', strikes it down

The Supreme Court docket struck down on Thursday the Khalsa College (Repeal) Act, 2017 as “unconstitutional“, saying the regulation singled out the college from 16 non-public varsities in Punjab.
A bench of Justices B R Gavai and Ok V Viswanathan stated, “No affordable classification has been identified to discriminate Khalsa College towards different non-public universities. The impugned act, subsequently, can be discriminatory and violative of Article 14 of the Structure.”
Khalsa College was established by the then SAD-BJP authorities in 2016, however when Captain Amarinder Singh authorities took over in 2017 it promulgated an ordinance repealing the 2016 Act and thereafter Punjab’s Vidhan Sabha handed the Khalsa College (Repeal) Act, 2017.
SC delivered its verdict on an enchantment filed by Khalsa College and Khalsa Faculty Charitable Society (KCCS), Amritsar, difficult the Nov 1, 2017 judgment of Punjab and Haryana HC that had dismissed a petition searching for quashing of the Act. Referring to a number of earlier judgments of SC, the bench quashed the HC verdict, saying, “There ought to be an affordable differentia on the idea of which an individual, entity or enterprise is sought to be singled out from the remainder of the group.”
